General Terms and Conditions

Article 1 – Definitions
The following definitions apply to these terms and conditions:
  • Consumer: a natural person whose actions are not for business purposes.
  • Day: calendar day.
  • Digital Content: data supplied in digital form.
  • Distance Contract: a contract for remote sale of products, Digital Content, or services.
  • Durable Medium: a means to store information for future reference.
  • Extended Duration Contract: a contract spanning a period for supplying products/services.
  • Outlet Products: products offered at a discount.
  • Privacy Policy: rules on privacy as specified by the Trader.
  • Right of Withdrawal: Consumer’s right to cancel a contract.
  • Technique for Distance Communication: methods for contract communication without meeting in person.
  • Trader: person or entity offering products/services to Consumers.

Article 3 – Applicability

Article 5 – The Contract
  • Contract concluded upon Consumer’s acceptance of offer.
  • Electronic acceptance confirmed promptly by Trader.
Article 6 – Right of Withdrawal
  • Consumer can cancel within 5 days of receiving products or services.
  • 5-day cancellation period for Digital Content.
Article 7 – Consumers’ obligations during the Withdrawal Period
  • Consumer must handle products with care during the withdrawal period.
Article 8 – Consumers who exercise their Right of Withdrawal and the costs involved
  • Consumer must notify Trader of withdrawal and return products promptly.
Article 9 – Traders’ obligations in case of withdrawal
  • Trader confirms withdrawal and refunds within 14 days.
Article 10 – Precluding the Right of Withdrawal
  • Specific products/services exempt from withdrawal.
Article 11 – The price
  • Prices clearly stated in offers.
Article 12 – Contract fulfillment and extra guarantee
  • Trader guarantees product/service accordance with contract.
Article 13 – Supply and implementation
  • Orders fulfilled promptly, or Consumer informed otherwise.
Article 14 – Extended duration transactions: duration, termination, and prolongation
  • Terms for terminating fixed-term contracts specified.
Article 15 – Payment
  • Payment terms and conditions detailed.
Article 16 – Deviations
  • Variances from website product images disclosed.
Article 17 – Text Messaging
  • Trader may send marketing messages with Consumer consent.
Article 18 – Privacy
  • Consumer data handled per Privacy Policy.
Article 19 – Intellectual Property
  • Trader retains intellectual property rights.
Article 20 – Liability
  • Trader limits liability where permissible by law.
Article 21 – Force Majeure
  • Trader not liable for delays due to force majeure.

Article 23 – Governing Law and Competent Court
  • Dutch law governs disputes.
  • Disputes settled in Groningen court or arbitration, as specified.
